Premise Liability
The California Civil Code Section 1714 Responsibility for Willful Acts and Negligence states:” Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”
What does this mean? It means that anyone who owns property has the responsibility to maintain their premises and keep it free from dangerous or hazardous situations that could cause harm to others. Premises liability refers to injuries or accidents that take place on another person’s residential or business property. The accident is usually the result of a dangerous or unsafe condition on the property.
Some common premises liability cases include:
· A roof cave in
· Uneven flooring
· Broken stairway banisters
· A balcony collapse
· Ice on steps or sidewalk
· Toxic substances (“sick building” syndrome)
· Broken glass
· Mold or slippery plant growth on walkways
